Mr.Murali Vinoth, S.C., For R1 & R2 In All WPs Mr.C.S.K.Satish, S.C., FOR R3 In All WPs COMMON ORDER These writ petitions have been filed to direct the respondents-Transport Corporation to pay the petitioners interest at the rate of 12% per annum on the belated payment of their Provident Fund (PF), Gratuity, Earned leave, Surrender Leave, Commuted Value of Pension.
2. The learned counsel for the petitioners would submit that the Page No.3 of 7
petitioners were employed as Drivers and Conductors in the respondentsTransport Corporation. After attaining the age of superannuation, the petitioners were retired from their service respectively. However, their retirement benefits were paid belatedly without paying any interest. It is the submission of the petitioners that they are entitled for the interest for the belated payment. In this regard, they have submitted representations dated 01.04.2025 and 02.04.2025 respectively to the respondents-Transport Corporation.
3. The learned Standing Counsel appearing on behalf of the Transport Corporation would fairly concede that in view of the similar orders passed by this Court in W.P.Nos.40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4. In view of the above submission, this Court deems it appropriate to direct the respondents to pay the interest at the rate of 6% per annum from the date of retirement till the date of actual disbursal of the terminal benefits to the Page No.4 of 7
petitioners, within a period of six (6) weeks from the date of receipt of a copy of this order.
5. With the above directions, these Writ Petitions stand disposed of. No costs.
