ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under section 381 of IPC, in Crime No.328 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the defacto complainant are close relatives. The petitioner was working as labour for long days under the defacto complainant shop. It is alleged that the petitioner took away the car and Rs.5,00,000/-, which belongs to the defacto complainant and left without inform. Based on the complaint lodged by the defacto complainant, the respondent police registered a case against the petitioner. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel appearing for the petitioner submits that the petitioner is no way connected with the occurrence as alleged by the prosecution and he has been falsely implicated in this case. He further submits that the vehicle as well as the amount has been recovered. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Public Prosecutor submits that the accused/petitioner absconded and has not co-operated with the investigation. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and as well as objections by Police , this Court is not inclined to grant anticipatory bail to the petitioner.
