O R D E R
The petitioner has come up with the Writ Petition for issuance of Writ of Mandamus to direct the respondents to consider the petitioner's representations dated 07.05.2012, 25.03.2013, 24.06.2013 and 26.08.2013.
2. The writ petitioner claims to be the President of Adayalchery Village Panchayat. The petitioner states that on 27.02.2011, the 1st respondent inaugurated the Periyar Samathuva Puram within the limits of the said Panchayat. During that time, the beneficiaries from Schedule Caste, Most Backward Class, Backward Class and from Other Caste, were selected. After inauguration, the first respondent did not hand over the keys to the beneficiaries. Therefore, the petitioner was forced to file a writ petition in W.P.No.21588 of 2013 and as per the order passed in the writ petition, the 1st respondent handed over the https://hcservices.ecourts.gov.in/hcservices/
keys to the 74 allottees out of 90 allottees. Since 16 beneficiaries have not been handed over the keys, the petitioner sent representations, but no favourable reply was given. Hence, the present writ petition.
3. The learned Government Advocate appearing for the respondents submitted that if the petitioner still has any grievance, she may be directed to give a representation to the 1st respondent, which will be considered in accordance with law.
4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.
5. Taking note of the facts of the case and in the light of the above submissions, this Court, directs the petitioner to give fresh representation to the 1st respondent within a period of two weeks from the date of receipt of a copy of this order, by enclosing a copy of this order. On such compliance, the 1st respondent shall consider the petitioner's representation and pass orders on merits and in accordance with law, after providing an opportunity of hearing to the necessary parties with six weeks therefrom.
6. With the above observations and direction, the Writ Petition is disposed of. No Costs.
