The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 406 & 420 r/w 34 of IPC, in Crime No. 89 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is one of the Director of M/s.Nandi Irrigation System Private Limited and they entered into a business of PVC raw materials with the defacto complainant. Though the defacto complainant supplied the raw materials to the petitioner, the petitioner failed to pay the amount for the said materials worth about Rs.11,79,08,234.29/- to the defacto complainant. Hence, the complaint.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any condition that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner has cheated the defacto complainant worth about Rs.11,79,08,234.29/-. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Considering the above fact and circumstances of the case and also on considering the gravity of offence committed by the petitioner and more than 11 Crores amount was involved in this case and further there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Already direction was given to the respondent police to take necessary steps to secure the accused persons to complete the investigation within a period of three months vide order dated 12.03.2024 in Crl.O.P.No.27052 of 2023. Hence, the respondent is directed to comply the said order of this Court.

7. Accordingly, this Criminal Original Petition is dismissed. 26.09.2024 mfa
