ORDER

This Civil Miscellaneous Petition has been filed to condone the delay of 339 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

3. Miss Saipooja, learned representing counsel would state that Mr.Sivakolappan undertakes to file vakalat for the 2 nd respondent and has got objections in allowing the application.

4. The petitioner would aver that due to his ill health, he was not in a position to give instructions to his Advocate for preferring the appeal and hence in the said process, a delay of 339 days had occurred in filing the appeal.

3. Accepting the averments made in the affidavit filed in support of this petition, this petition is allowed subject to the condition that the interest for the delay period of 339 days shall stand waived. msr 14-11-2025
