This application has been filed to appoint a Receiver to take control of the property bearing Door No.6 (Old No.15) in Kamaraj Park Lane, (Old Municipal Door No.81 to 83 and 1/84 and 2/84) Suryanarayana Chetty Street, Royapuram, Chennai-600 013, measuring 2 grounds and 2385 sq.ft. morefully described in the schedule, and regulate, collect all rents from existing and prospective car owners who intend to park their vehicle in the premises and also collect any rent accrued from and out of the premises, and deposit all the rental accruals to the bank account to be opened in any scheduled bank specifically for the said purpose as directed by this Court and distribute the rental accruals to the parties on establishing their claim before this Court.

The learned counsel for the applicant/plaintiff submitted that having a direction given by this Court on 07.09.2023, the respondents/defendants have not rendered proper accounts as to the collection of rent received by them in respect of suit A schedule property. He further submitted that the defendants are receiving a sum of Rs.1,00,000/- as rent from the suit A schedule property.
4. The learned counsel for the respondents/defendants submitted that the defendants have rented out the schedule A property for car parking and only around 15 cars are parking per day and they are receiving a sum of Rs.2,000/- per month as rent for each car.
5. Considering the submissions made on either side and in the interest of justice, this Court is inclined to direct both the parties to collect the rental amount from the suit A https://www.mhc.tn.gov.in/judis schedule property and deposit the same into Court.
