Respondents Prayer : Original Application No.5781 of 2002 filed before the Tamil Nadu Administrative Tribunal, on abolition, transferred to the file of this Court and renumbered as Writ Petition No.13293 of 2006, seeking for a writ of Certiorari to call for the records of the proceedings of the second Respondent in No.23015/ES3/2002 dated 18.7.02 and quash the same as illegal and consequently direct the Second Respondent, in consultation with the First Respondent, to include the name of the applicant in the appropriate place in the panel of Grade I Warders fit for promotion as Chief Head Warder for the year 2001-2002 communicated in proceeding no.23015/ES3/2002 dated 27.06.2002 in the Prison Department and direct the Second Respondent to appoint the applicant as Chief Head Warder retrospectively in so far the petitioner herein is concerned.

2. The grievance of the petitioner is that the first respondent has not included the name of the petitioner in the appropriate place in the panel of Grade I Warders fit for promotion as Chief Head Warder for the year 2001-2002 and consequently he was not appointed as Chief Head Warder.

3. When the matter is taken up for hearing, the learned Special Government Pleader appearing for the respondents has submitted that the petitioner was promoted as Chief Head Warder and his name has been revised and placed in Sl.No.6(a) of the revised list of Chief Head Warders fit for promotion to the post of Assistant Jailer for the year 2009-2010 and he was also promoted as temporary Assistant Jailer on 31.07.2010 and on attaining the age of Superannuation he retired from service on 30.09.2011. The learned Special Government Pleader has also produced the proceedings of the Inspector General of Police and Inspector General of Prisons, Chennai dated 31.07.2010 and proceedings of the Superintendent of Prisons, Central Prison II, Puzhal dated 30.09.2011 to that effect.

4. Recording the submissions made by the learned Special Government Pleader, this Writ Petition stands dismissed as infructuous. No costs.
