These applications have been filed seeking to condone the delay of 387 days in filing the application to set aside the abatement caused due to the death of the 2nd plaintiff, to set aside the abatement and to bring on record the proposed applicants as legal heirs of the the deceased 2nd plaintiff.

2. Heard the learned counsel for the applicants and the learned counsel appearing for the respondents.

3. In view of the death of the 2nd plaintiff, the impleadment of her legal heirs is inevitable and unless the legal representatives of the deceased 2nd plaintiff is impleaded, the further progress in the suit is not possible. In order to clear the technical restraints, I feel these petitions should be allowed and accordingly the applications are allowed.

4. The applicants / plaintiffs are directed to file amendment application for carrying out amendment along with the amended copy of the plaint by 14.06.2023.
