No representation for the petitioner. The learned Government Advocate would contend that the investigation in Crime No.1008/2003 on the file of the Inspector of Police, Thuraipakkam Police Station had already been concluded and final report is filed before the Judicial Magistrate, Alandur, against the accused (present petitioner) for the alleged offence punishable under Section 279 and 304(A) IPC.

2. The petitioner has mainly contended that there is a delay in filing the charge sheet before the competent Court and that the said delay would affect his right guaranteed under the Constitution of India.

3. As per the version of learned Government Advocate (Crl.side), the final report was filed as early as on 20.01.2004 and therefore nothing survives for further adjudication.

4. Accordingly, the criminal original petition is dismissed. Consequently, connected miscellaneous petition is closed.
