This Civil Miscellaneous Petition has been filed to condone the delay of 599 days in filing the above appeal.

2.Heard the learned counsel for the petitioner and the 2nd respondent.

3.Learned counsel for the 2nd respondent has got serious objections in allowing the application as the petition has been taken out to condone the delay of 599 days in preferring the above C.M.A.

4.The 1st petitioner would aver that on account of the accident, her husband died and due to financial constraints, a delay of 599 days occurred in preferring the above C.M.A.

5. Accepting the averments made in the affidavit filed in support of this petition, this petition stands allowed. The interest for the delay period of 599 days is hereby waived.
