2. However, the learned counsel appearing for the second respondent would submit that they have received no instructions with regard to attainment of 12(3) Settlement between the petitioner and the respondent Corporation, as cited by the learned counsel for the petitioner.
3. Considering the submissions made by the learned counsel appearing for the 2nd respondent, the statement of the petitioner that they have entered into a 12(3) Settlement is hereby not considered.
