By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also the limited relief that is sought to be granted, notice to the Respondent No.3 is dispensed with.
2. The present writ petition is filed challenging the impugned order impugned order No.1024/2016/A2 dated 27.02.2018 and consequently direct the second respondent to restore the Patta No.703 in the name of the petitioner.
3. After submitting for a brief while, it was pointed out by the learned Additional Government Pleader that what is challenged in the writ petition is only the original proceedings dated 27.02.2018 passed by the second respondent, however the same was the subject matter of appeal before the District Revenue Officer. The appeal came to be disposed of vide order dated 03.01.2024. In view of the fact the appellate authority has already passed an order, the original order would merge and may no longer survive. If at all, the petitioner is aggrieved, he could only challenge the order of the appellate authority dated 03.01.2024.
4. At this juncture, learned Senior Advocate for the petitioner would submit that liberty may be granted for filing a writ petition challenging the order 2/4
dated 03.01.2024, if so advised.
5. In view thereof, the writ petition stands closed with liberty as prayed for. There will be no order as to costs. Consequently, connected miscellaneous petitions are closed.
