Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider and pass orders on the representations of the petitioners dated 05.10.2023, 25.04.2024 and 13.06.2024 and consequently issue a joint patta upon including the names of the petitioners.

O R D E R

The petitioner herein seeks a direction to the respondents 1 to 3 to consider the representations of the petitioners dated 05.10.2023, 25.04.2024 and 13.06.2024 and issue a joint patta in the names of the petitioners and other legal heirs of the petitioners' parents Raman and Karuppayye.

2. It is the case of the petitioners that their parents Raman and Karuppayye owned 4.50 acres of the land in Kurukapuram Village, Rasipram Taluk, Namakkal District and the patta in respect of the said property was wrongly mutated in favour of the other legal heirs i.e., petitioners brothers 2/5

namely Kandhan, Muthan and Atthi @ Perumal. Therefore, the petitioners submitted the representation on various dates seeking cancellation of patta issued in the name of some of the heirs and issue of patta in the names of all the legal heirs of original owners including the petitioners. The last of such representation was dated 13.06.2024 and the same has not been considered till date. Therefore, the petitioner is before this Court.

3. Mr.A.Selvendran, learned Special Government Pleader, who takes notice for the respondents 1 to 3 would submit that the representation of the petitioner would be considered on its own merits, within a time frame to be stipulated by this Court.

4. In view of the above submission of the learned Special Government Pleader, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the second respondent to consider the representation of the petitioner dated 13.06.2024 and pass final orders, after issuing notice to the petitioners and respondents 4 to 10 and other interested parties, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
