PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to issue direction to the dispense with the appearance of the petitioner husband and permit him to represent through his power agent in M.S.No.125 of 2017. ORDER
The prayer sought for in the present petition seeking for a direction to dispense with the petitioner's appearance and permit him to represent through his power agent in the maintenance case cannot be considered. Since the petitioner's application made in this regard in M.P.No.238 of 2010 is said to be pending, under these circumstances, if the maintenance petition seeking for a similar relief is directed to dispose of, then the ends of justice could be secured.
At this juncture, the learned counsel for the respondent brought to the notice of this Court, the earlier order dated 01.08.2018 passed in Crl.R.C.No.781 of 2018, this Court had passed directions to the trial Court to complete the proceedings within a period of 12 week and in spite of such a proceedings have been kept pending.
In the light of the above observations and without going into averments made in the petition, the learned V Additional Family Court Judge, Chennai, has called upon to be endeavour to pass final orders in M.P.No.238 of 2019 as expeditiously as possible, in any event within a period of 30 days from the date of receipt of a copy of this order. https://hcservices.ecourts.gov.in/hcservices/
With the above direction, this Criminal Original Petitions stands disposed of.
