Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents to measure the extent of Ac. 5.27 purchased by the petitioner in new S.No.15/1A1A = old S.No.545 in Vadakuthu Village, Kurinjipadi Taluk, Cuddalore District, give a separate survey number or sub-division and consequently issue patta to the petitioner.

O R D E R

The petitioner has come up with this writ petition for issuance of writ of mandamus to direct the the respondents to measure the extent of Ac. 5.27 purchased by the petitioner in new S.No.15/1A1A, old S.No.545 in Vadakuthu Village, Kurinjipadi Taluk, Cuddalore District, give a separate survey number or sub-division and consequently issue patta to the petitioner.

2. The learned counsel for the petitioner submitted that though the petitioner is the owner of the land to an extent of 5.27 acres in S.No.15/1A1A, the name of the petitioner was not included in the joint patta, nor he was issued with separate patta, hence, the present writ petition.

3. The learned Government Advocate for the respondents submitted that the petitioner without approaching the respondents by submitting a representation, has filed the present writ petition. If a representation is given by the petitioner, it would be considered in accordance with law.

4. In the light of the above facts and submissions of both sides, this Court directs the petitioner to give fresh representation to the 2nd respondent within a period of two weeks from the date of receipt of a copy of this order, by enclosing a copy of the same. On such compliance, the second respondent shall consider the same and take appropriate action in accordance with law, within a period of twelve weeks therefrom.

5. With the above observation and directions, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
