The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 465, 467, 468, 471, 420 and 34 of IPC in Crime No.155 of 2022, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with the other accused conspired and by impersonation and fabrication of the documents, transferred the properties belonging to the defacto complainant to the third parties. Hence, the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that he has believed the statement of one Venkatesan, who is the close friend of the petitioner and agreed to stand as Power of Attorney of Natarajan @ Elangovan. Other than that, he is not aware of anything. Hence, he prays for grant of anticipatory bail to
the petitioner.
4.Per contra, the learned Government Advocate (Crl. Side) would submit that the petitioner conspired with the other accused and by fabricating and forging of documents, created a Power of Attorney based on which, they have transferred the properties belonging to the defacto complainant to the third parties. He would further submit that the investigation is at the initial stage and the custodial interrogation of the petitioner is very much required in this case. Hence he vehemently opposed for the grant of anticipatory bail to the petitioners. 5.Heard the learned counsel appearing for the petitioner as well as the learned Government Advocate (crl.side) appearing for the respondent and perused the entire materials available on record. 6.On perusal of the records, it is seen that the petitioner is said to be the person to whom the Power of Attorney has been given and this Court is of the opinion that the custodial interrogation of the petitioner is
verymuch essential in this case.
