ORDER

This Transfer Civil Miscellaneous Petition has been filed seeking transfer of petition for divorce filed by the respondent-husband in 1/4

H.M.O.P.No.229 of 2022 from the file of Second Additional Subordinate Judge, Coimbatore to Subordinate Judge at Bhavani, Erode District. 2.According to the petitioner/wife, she is residing at Komarapalayam within the territorial limit of the Subordinate Court, Bhavani along with her parents. It was also stated that she is having school going daughters. As a lady, she finds it very difficult to undertake long travel to Coimbatore to attend Court hearing.

3.It is settled law that in the matter involving matrimonial dispute, the preference shall be given to the convenience of the petitioner/wife.

4. In the case on hand, the petitioner is residing at Komarapalayam. She had also expressed difficulty in undertaking long travel and attending Court hearings at Coimbatore.

5. Therefore, this Court is inclined to order the Tr.C.M.P. Petition. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. The 2/4

petition filed in H.M.O.P.No.229 of 2022 pending on the file of the Second Additional Subordinate Judge, Coimbatore is withdrawn and transferred to the Subordinate Judge, Bhavani, Erode District. Consequently, connected miscellaneous petition is closed. No costs.
