Respondent PRAYER: Petition has been filed under section 226 of the Constitution of India to issue an order of Writ of Mandamus, directing the respondent to give promotion to the petitioner as Deputy Block Development Officer in the panel year of 20042005 as per Rule 39 (d) of the Tamil Nadu State and Subordinate Service Rules, without reference to the criminal case and to pass further orders.

The Writ Petition has been filed by Mr. R.Mathivanan, under Article 226 of the Constitution of India,

seeking for a direction to the respondent to give promotion to the petitioner as Deputy Block Development Officer in the panel year of 2004-2005 as per Rule 39 (d) of the Tamil Nadu State and Subordinate Service Rules, without reference to the criminal case and to pass further orders.

2. Learned counsel appearing for the petitioner submitted that the relief sought for in this Writ Petition has become infructuous, as the petitioner has attained the age of superannuation. He has also made an endorsement to that effect.
