The petitioner herein seeks protection from harassment at the hands of the 1st respondent police alleging that under the guise of investigating the Crime No.165 of 2022 registered on the complaint 1/4

given by one Sridevi, the Inspector of Police for the offence under Sections 328 of IPC, Sections 6 & 9 (ii) of Tamil Nadu Prohibition of Smoking & Spitting Act, 2003 and Section 24(1) of Cigarette and Other Tobacco Products Act, 2003.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the petitioner herein who is the habitual offender wants to be detained under the Goondas Act and recently case in Crime No.151 of 2024 dated 12.07.2024 for offence under Section 123 BNSS Act and 6(a), 24(1) Section 24(1) of Cigarette and Other Tobacco Products Act, registered against this petitioner. Being an habitual offender of illegal trade of prohibited tobacco products and absconding in Crime No.151 of 2024, the police is in search of the petitioner herein.

Recording the submission made by the learned Government Advocate (Crl.Side), this Criminal Original Petition is dismissed as devoid of merits.
