(The Superintending Engineer-Vs-The Labour Inspector).

O R D E R

The matter was heard for some time earlier and during the pendency of the present litigation, by proceedings dated 21.04.2018, The first petitioner(Mr.R.Muthusamy) has been granted employment by the respondent Board.

2. The learned counsel for the petitioner would submit that in respect of the other writ petitioner, he is not pressing the case. The learned counsel would also submit that as far as the other similarly placed petitioners are concerned, they were granted appointment earlier and unfortunately, the first petitioner came to be appointed only in April 2018.

3. However, from the pleadings and materials placed on record, this Court is of the view that as far as the present writ petition is concerned, nothing survives for further consideration before this Court. Therefore, the writ petition is closed as having become infructuous. However, if the first petitioner is still has any grievance, he can make representation to the Board for parity in treatment and the same shall be considered by the Board on merits and in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
