This petition is filed to bring on record the legal heirs of the deceased third respondent and rank them as respondents 5 to 7 in the above appeal.

2.Though notice was served on the proposed respondents and there is no representation on behalf of them and this Court is satisfied with the reasons assigned in the affidavit filed in support of this petition. Hence, This petition is allowed.

3.The Registry is directed to carryout necessary amendments in the Second Appeal No.1279 of 2009 and list the matter for final hearing after four weeks.
