CMP.No.8180/2023 and A.S.No.35/2012 SATHI KUMAR SUKUMARA KURUP.J., The learned Counsel for the Petitioner submits that this Petition has been filed to restore the Appeal in A.S.No.35/2012 which was dismissed by this Court. This Civil Miscellaneous Petition was filed along with Petition in CMP.No.19256/2022 to condone the delay.

2. CMP.No.19256/2022 was allowed on payment of costs, as per Order dated 01.02.2023, directing the Petitioner/Appellant to pay a sum of Rs.20,000/- to the Respondent. Accordingly, he had paid costs to the Respondent and on the basis of the same, CMP.No.19256/2022 was allowed on 01.03.2023.

3. In continuation of the same, this Petition had been posted for Orders.

4. The learned Counsel for the Respondent present in Court and stated that he has no objection.

5. In the result, this Civil Miscellaneous Petition is allowed and A.S.No.35/2010 is restored.
