PRAYER: Writ Petition filed Under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned order dated 31.07.2019 in file No.2019/0103/08/165768 passed by the 2nd respondent and quash the same, consequently direct the 2nd respondent to sub-division and issue separate patta for the pathway in S.No.152/3D, Marakottai Village, Omalur Taluk, Salem District based on the pathway deed dated 27.03.2019 in Doc.No.2551 of 2019 within a stipulated time. The learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition and he has also made the following endorsement to that effect:

2.In view of the endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed, with liberty to the petitioner to file an appeal. If the appeal is filed on or before 31.01.2020, then the delay in filing the appeal would be condoned by the concerned official. If the appeal is filed after 31.01.2020, then necessary explanation regarding delay has to be given. No costs.
