ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus to direct the respondents to register the petitioner's Settlement deed dated 20.06.2025 based on online token temporary No.TP/223552938/2025 and Reservation Serial No:1 (D-501) dated 20.06.2025 on the file of the third respondent in accordance with law.

It is submitted by the learned counsel for the petitioner that the petitioner is the absolute owner of the property, comprised in Survey No.399/4 situated at Gottupullampalayam Village, Gobichettipalaiyam, Erode District. The petitioner proposed to settle the subject property in favour of his daughters. Hence, he executed a settlement deed on 20.06.2025 and applied for online registration and also received token from the third respondent office in temporarily No.TP/223552938/2025 and Reservation Serial No:1 (D-501). 2/5
Thereafter, the petitioner submitted necessary documents before the third respondent. However, the third respondent returned the documents without any refusal order. Hence, the petitioner has filed the present writ petition.

At the outset, it was submitted by the learned Government Advocate that it is not clear as to whether the petitioner had even presented the above settlement deed dated 20.06.2025 before the third respondent. If the settlement deed dated 20.06.2025 is presented before the third respondent, the same would be registered, if it is otherwise in order. If, for any reason, the Sub Registrar is of the view that the registration ought to be refused, he would do so after assigning reasons, which was agreed to by the learned counsel for the petitioner.
5. In view thereof, it is open to the petitioner to present the settlement deed dated 20.06.2025 before the third respondent. On such presentation, the third respondent shall register the settlement deed, if it is otherwise in order, in accordance with law. If for any reason, the third respondent refuses to register the settlement deed, he shall assign reasons in the refusal slip, which was agreed to by both counsel for petitioner as well as respondents. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in 3/5
accordance with law.
6. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
