ORDER

This Transfer Civil Miscellaneous Petition has been filed to withdraw FCOP.No.8 of 2024 on the file of the Family Court, Chengalpattu, and to transfer to the file of the Sub-Court, Ponneri. 2.The petitioner is the wife and respondent in FCOP.No.8 of 2024, 1/4

which has been filed by the respondent/husband, seeking dissolution of the marriage with the petitioner. The petitioner, expressing her genuine difficulties in travelling to the Family Court, Chengalpattu, has now sought for transfer of the proceedings to the file of the Sub-Court, Ponneri, within whose jurisdiction the petitioner resides.

3.The respondent, despite service of notice, has not chosen to appear either in person or through counsel. The name of the respondent is also printed in today's cause list. The respondent is called and set ex-parte. 4.I have heard the learned counsel for the petitioner. I have also gone through the affidavit filed in support of the transfer petition. 5.The petitioner has stated that she is blessed with a male child aged 2 1⁄2 years and further, she also has to take care of her aged parents thereby finding it very difficult to attend the hearings at Family Court, Chengalpattu. In any event, the petitioner only seeks transfer of proceedings to the SubCourt, Ponneri, where the physical appearance of the parties may not be strictly insisted upon. Therefore, no serious prejudice would be caused to the 2/4

respondent.

6.In the light of the above, this Transfer Civil Miscellaneous Petition is allowed. The case in FCOP.No.8 of 2024 is hereby withdrawn from the file of the Family Court, Chengalpattu and transferred to the file of the SubCourt, Ponneri. There shall be no order as to costs. Connected Civil Miscellaneous Petition is closed.
