The petitioner, who was tried as Accused No.1 in S.C.No.68 of 2019 on the file of the Additional District Fast Track Court, Mettur, stands convicted and sentenced for the offence as detailed below:- Convicted u/s Sentence imposed 294(b) IPC To pay a fine of Rs.500/-, i/d to undergo 2 weeks S.I. 324 IPC To pay a fine of Rs.2000/-, i/d to undergo 3 months S.I. 302 IPC To undergo imprisonment for life and to pay a fine of Rs.10,000/-, i/d to undergo 1 year R.I.
A2 to A4, who were also convicted and sentenced for the offence as stated therein, have also filed the above appeal along with A1. Pending the same, he has taken out the present petition seeking to suspend the sentence and enlarge him on bail.

3. Having regard to the nature of injuries and the manner in which the Page No.1/3
deceased was assaulted by the accused, this Court is not inclined to entertain this petition. The doctor has given a report about the nature of injury and has also stated that the cause of death is due to internal bleeding and the injury that was caused to the heart. Fact that the accused have beaten the deceased to death is accepted by the trial Court while convicting and sentencing the accused. Hence, this Court, finding no prima facie case in favour of the petitioner, is not inclined to suspend the sentence. Accordingly, the criminal miscellaneous petition stands dismissed. (S.S.S.R.,J.)
