Mr.B.Pachaiyappan,Government Counsel Order This Writ Petition has been filed seeking a direction to the 1st respondent to consider the petitioner's application dated 08.01.2026 for the exchange of his patta lands for Government lands situated in S.F. No. 9/1, measuring an extent of 94 cents.
2. The petitioner owns lands/properties in S.F. Nos. 8/11 and 8/12, measuring an extent of 80 cents, situated at Orkattupettai Revenue Village, Uthiramerur Taluk, Kancheepuram District. Adjacent to the petitioner's lands, an extent of 94 cents of tharisu (wasteland) comprised in S.F. No. 9/1 is in the possession and enjoyment of the petitioner for the past several decades, being utilized as a pathway to access his lands. Initially, the petitioner submitted an application before the revenue officials seeking the issuance of a patta for the lands in S.F. No. 9/1. However, due to alleged mala fide intentions of the 3rd
respondent (Panchayat President), the petitioner subsequently decided for an exchange of lands. Accordingly, the petitioner purchased an equivalent value of lands comprised in S.F. Nos. 258/2A and 258/3, totaling an extent of 66.47 cents, situated at Neeradi Village, Uthiramerur Taluk, Kancheepuram District. On 08.01.2026, the petitioner made an application to exchange his patta lands in S.F. Nos. 258/2A and 258/3 for the Government land in S.F. No. 9/1. Since the said application was not considered, the petitioner has approached this Court.
3. The learned Government Counsel appearing for the respondents submitted that respondents 2 and 3 have already conducted an enquiry and forwarded a report to the 1st respondent. Therefore, appropriate orders will be passed on the petitioner's application as expeditiously as possible.
4. Heard both sides and perused the materials available on record.
5. Under such circumstances, if there is absolutely no ingress and egress to the petitioner's land, it is the duty of respondents 1 and 2 to resolve the issue by providing an appropriate pathway. In the present case, since the petitioner has also submitted an application for the exchange of his private patta land with Government land, respondents 1 and 2 are bound to consider the same on its merits.

Hence, respondents 1 and 2 are directed to consider the petitioner's application dated 08.01.2026 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. Furthermore, if the respondents have no active proposal to issue a patta for the said 94 cents in S.F. No. 9/1 to any third party, they are directed not to create any third-party rights or pass any adverse orders regarding the status of the land until the disposal of the petitioner's application.
