No 13 / 2017 (Award No. 2 / 2018 ) NH - 209) dated 24.05.2018 in so far as the Petitioners land of extent 78 Sq.mts comprised in Survey No. 77 / 1B2B, Othakkalmandapam village, Madukkarai Taluk, Coimbatore District is concerned and pass appropriate orders thereon within a time limit to be fixed by this Court.

ORDER

This writ petition is filed seeking a mandamus, directing the 1st respondent to consider the petitioner's petition dated 24.06.2022 for enhancement of the compensation ordered by the 2nd respondent in Ref. No 13 / 2017 (Award No. 2 / 2018 ) NH - 209) dated 24.05.2018, in so far as the petitioner's land measuring 78 Sq.mts comprised in Survey No. 77 / 1B2B , situated at Othakkalmandapam village, Madukkarai Taluk, Coimbatore District. 2.

The learned Counsel for the petitioner would submit that the petitioner is the absolute owner of the land comprised in Survey No. 77 / 1B2B , measuring 78 sq.mts situated at Othakkalmandapam village, Madukkarai Taluk, Coimbatore District. He further submits that the subject land was acquired by the Highways Department for the purpose of maintenance and operation of the National Highway No.209 in District and an award was passed for the payment of compensation vide order dated 24.05.2018, fixing the value as Rs.2609/- per sq.mtr. He further submits that the petitioner filed a petition dated 24.06.2022, before the 1st respondent claiming enhancement of the compensation. However, the said petition was not considered as on date. Hence this writ petition.

The learned Additional Government Pleader appearing for respondents 1 and 2 would submit that the petitioner's petition dated 24.06.2022, will be considered within a period of 12 weeks. 4.

Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought by the learned counsel for the petitioner, this Court without expressing any opinion on the merits of the case, directs the 1st respondent to dispose of the petitioner's petition dated 24.06.2022, on merits and in accordance with law, within a period of twelve

(12) weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition stands disposed of. No costs.
