The petitioner herein is a History Sheeter. Earlier he came to this Court seeking police protection apprehending there is a threat at the hands of the rival.

This Court, after considering the submission made by the petitioner and the representation of the learned Government Advocate (Crl.Side), directed the respondent police that the petitioner shall be provided round O' clock surveillance and the patta passbook has to be opened and visit to the house of the petitioner shall be regularly recorded in it.

Taking note of the submission made by the learned counsel appearing for the petitioner, his earlier petition seeking protection was disposed of. Again alleging that the police is not regularly visiting his premises to give protection, the present petition is filed. 4.
The learned counsel appearing for the petitioner produced the passbook to emphasize that the police is not visiting the residence to ensure the safety of the petitioner. When a pertinent question put to the petitioner's counsel that how the passbook, which is the property of the police been come to his possession, the learned counsel states that to demonstrate that the police is not visiting the residence he has brought 2/4
the passbook.

However, the learned Government Advocate (Crl.Side) appearing for the respondent police states that the petitioner herein to make misrepresentation to the Court that the police is not keeping proper surveillance over his protection, has taken away the passbook note. Therefore, to record their visit to the residence of the petitioner thrice in a day on each visit police has taken photograph in their said book and kept in record.

This Court is of the view that the petitioner who is already in the adverse notice of the police tried to misuse the law and exaggerate his fear, but not ready to submit himself into law and get protection from the police and patta passbook which was kept by the police to enthusiastic compliance of protection direction by the Court on 17.04.2024 been removed by the petitioner herein to show as if the order of the Court not been properly complied by the police. 3/4

This Court is of the view that this petition has been filed with some ulterior motive and requires to be dismissed. Hence this Criminal Original Petition is dismissed.
