ORDER
The petitioner is before this Court seeking to re-open the Contempt Petition disposed of vide order dated 08.04.2025 and to initiate contempt proceedings against 1st and 2nd Respondents for not complying with the order dated 25.09.2024 in W.P.No.16559 of 2024.
2. Operative portion of the order dated 25.09.2024 reads as follows :
"In the light of the above, this writ petition is allowed by quashing the impugned Show Cause Notice by directing the respondents to finalize the pension papers of the petitioner and start paying pension from 1st of November of 2021 regularly. The respondents are also directed to pay arrears of pension together with the applicable statutory rate of interest on the delayed payment of terminal benefits and pension within the aforesaid period."
3.The learned Additional Advocate General Mr.Neelakandan submits that direction in Paragraph No.4 of the order dated 25.09.2024 of this Court has been complied with. It is stated that it is in this background, the above contempt petition was closed by this Court by an order dated 08.04.2025. It is further submitted that the petitioner is now seeking for 2/5
increment and has given representations dated 02.12.2024 and 27.01.2025 for the same.
4.These are separate matters arising out of the relief that has been granted to the petitioner pursuant to the order of this Court. It is therefore open for the petitioner to persuade the respondent by approaching the authorities in the manner known to law. Therefore, the Sub Application is liable to be dismissed with the above liberty. 5.In view of the above, the Sub Application is dismissed. However, liberty is granted to the petitioner to work out his remedy with regard to the claim for increment by submitting appropriate representations to the competent authority in the manner know to law. 30.01.2026 Index : Yes/No Internet : Yes/No Lpp 3/5
