Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, for the issuance of a Writ of Mandamus directing the 1st respondent to establish proper infrastructure of conducting the Court proceedings at 2nd respondent's office by appointing sufficient staffs enabling to conduct cases, maintaining the Court records, Diary, Numbering transferred cases from other offices and there by dispose of the representation of the petitioner dated 26/03/2021, 28/09/2022, 07/12/2022 and 15/11/2023.

ORDER

This writ petition has been filed seeking a direction to the 1st respondent to provide adequate infrastructure in the office of the 2nd respondent and consequently to ensure expeditious disposal of the cases pending on its file, by considering the petitioner's representation, lastly dated 15.11.2023.

2. Learned counsel for the petitioner submitted that the petitioner is a practising Advocate at the Salem Bar Association and is conducting several matters under the provisions of the H.R. & C.E. Act. Initially, the said cases were pending before the Joint Commissioner, Salem. Subsequently, in the year 2020, the cases were transferred to the file of the Joint Commissioner, H.R. & C.E., Tiruvannamalai. It is the grievance of the petitioner that there was no adequate infrastructure in the said office, due to which the cases were not taken up for effective hearing, compelling the petitioner to approach this Court. Therefore, he prayed for issuance of appropriate directions in the above regard. 2/4

Per contra, the learned Government Advocate appearing for respondents 1 & 2 submitted that subsequently, the cases have been transferred to Joint Commissioner, Dharmapuri, pursuant to the proceedings of the Joint Commissioner, Tiruvannamalai dated 09.03.2025. . He further submitted that the office at Dharmapuri is well-equipped with necessary infrastructure and there is no impediment for the petitioner to prosecute the cases before the Joint Commissioner, Dharmapuri. Therefore, no further adjudication is required in this writ petition.

4. Recording the aforesaid submissions, this writ petition stands disposed of. No costs.
