The petitioner, who was arrested and remanded to judicial custody on 24.06.2023 for the offences punishable under Sections 406, 407 & 420 of IPC in Crime No.361 of 2022 registered by the respondent police, seeks bail.
2. The petitioner is the 2nd accused and the 1st accused was his father, who had unfortunately subsequently died. But, that is not a ground on which the petitioner was granted interim bail. The petitioner was granted interim bail with a specific condition that he should settle the issue with the defacto complainant.
3. It is stated that both the accused had taken money from the defacto complainant through online on the ground of running a vegetable market. Therefore, the defacto complainant had suffered a loss of Rs.4,00,000/-. The petitioner was granted more than sufficient time by an order of granting interim bail on 16.08.2023 to settle the issue.
4. The learned counsel for the petitioner states that the petitioner is 1/3
working in a banian factory at Tiruppur and he could not settle the entire amount but he can settle it in installments and that he would pay the 1st installment of Rs.50,000/- and thereafter, staggered installments of Rs.12,000/- per month. But however, that had not been put forth when the interim bail was granted.

Taking into consideration all these factors and taking note of the fact that the petitioner still has the benefit of interim bail either he has to surrender or has to be taken into custody by the respondent police, I am not inclined to grant bail in the main matter. Accordingly, this Criminal Original Petition stands dismissed. Consequently, the petition to intervene is also closed.
6. The petitioner shall surrender before the respondent police on or before 30.10.2023. If the petitioner does not surrender on or before 30.10.2023, the respondent is directed to take him into custody. 17.10.2023 ata C.V.KARTHIKEYAN,J.
