ORDER

The present criminal original petition has been filed to call for the records culminating in the criminal proceedings pending against the petitioner in C.C.No.238 of 2013 on the file of the learned Judicial Magistrate No.II, Tiruppur and quash the same.

2. It is the case of the petitioner that on the basis of the complaint given by the respondent as against the petitioner and 10 others before the learned Judicial Magistrate No.II, Tiruppur, a case was registered in C.C.No.238 of 2013 and same is pending. Now, to quash the said proceedings as against the petitioner, the present petition has been filed.

3. Today, when the matter was taken up for consideration, learned counsel appearing for the respondent has fairly conceded that there cannot be any charge as against the petitioner.

4. The said submission made by the learned counsel appearing for the respondent is hereby recorded and the proceedings in C.C.No.238 of 2013 pending on the file of the learned Judicial Magistrate No.II, Tiruppur, is quashed as against the petitioner alone. The learned Judicial Magistrate No.II, Tiruppur, is directed to proceed with the case in C.C.No.238 of 2013 relating to other accused and expedite the trial.
