Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, forbearing the respondents 1 to 3 or their sub-ordinates/agents from initiating or proceedings with any promotion process and promoting officers for the posts of Scale II,III,IV,V,VI,VII Officers in the 1st respondent Bank without first providing for reservations of 15% and 7 1⁄2 % of the said posts to the employees belonging to Scheduled Caste and Scheduled Tribes respectively and acting on that as per Article 16(4-A) of the Constitution of India read with the office memorandum of the Government of India dt.13.08.1997 and the factual position that there is inadequate representation in those posts. The learned counsel appearing for the writ petitioner made a submission that after filing of the writ petition, the rules in relation to the recruitment and promotion have underwent changes and at present, the respondents are bound to follow the rules in force for affecting appointment/promotion. In view of the changed circumstances in the subject, no further adjudication needs to be undertaken and if any grievances, it is left open to the writ petitioner in respect of the current rules, they are at liberty to approach the appropriate authorities to redress their grievances.
