O R D E R

Petitioner/husband, who is presently residing in Thiruvannamalai, has come up with this Petition seeking transfer of F.C.O.P.No.39 of 2019 from the file of the Family Court, Chengalpattu to the Principal Subordinate Court at Kancheepuram.

2. Learned counsel appearing for the Respondent submitted that, the Respondent/wife has no objection for the proceedings in F.C.O.P.No.39 of 2019 being transferred to the Principal Subordinate Court at Kancheepuram. However, it is represented that the Petitioner is not attending the counselling sessions and is not co-operating in mediating the matter.

3. The purpose of transfer is to bring about a settlement between the parties at the earliest point of time, otherwise, the litigation will not reach finality.

4. In view of the above, the proceedings in F.C.O.P.No.39 of 2019 is withdrawn from the file of the Family Court at Chengalpattu and is transferred to the file of the Principal Subordinate Court at Kancheepuram, for trial. The Principal Subordinate Court at Kancheepuram, is expected to conclude the trial, as expeditiously as possible, without adjourning the matter beyond 45 working days at any point of time, to bring the issue to a logical end.

5. The Petitioner/husband is expected to appear before the Mediator, on all counselling sessions, whenever, his presence is required.

6. The Transfer Civil Miscellaneous Petition is allowed as indicated above. No costs.
