ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition has been filed praying for a writ of Mandamus, directing the Respondents herein to Execute Sale Deed Document No.2050/ 2024 in favour of petitioner for the remaining portion admeauring 153 sq.ft in respect of the property bearing Plot No.C18/ A1 at Arumbakkam Scheme situated in MMDA Colony, Arumbakkam, Chennai- 600 106.

3. The Petitioner is an allottee of a vacant land plot measuring to an extent of 573 sq.ft vide the allotment order dated 15.10.1995. While petitioner remitted the entire sale consideration for the said extent, the sale deed was executed only for an extent of 420 sq.ft. Consequently, petitioner submitted a representation to second respondent dated 02.03.2026 requesting execution of a sale deed for the remaining extent of 153 sq.ft. followed by a remainder letter dated 23.03.2026. However, no response has been received. Petitioner submits that he has put up construction over the said land measuring 573 sq.ft. and that

will suffer severe financial loss, and his property rights will be adversely affected if respondents fail to execute the sale deed for the remaining extent.

At the outset, the learned counsel appearing for the respondents would submit that petitioner's request would be considered and appropriate orders would be passed after issuing notice to petitioner and any other interested parties, within a time period to be stipulated by this Court. He would further submit that the petitioner must approach the Executive Engineer & Administrative Officer, K.K.Nagar Division, Tamil Nadu Housing Board, Chennai, for appropriate orders. Agreed to by the learned counsel for petitioner.

5. In view of the above submissions made by the learned counsel for respondents, this Court deems it fit to suo motu implead the Executive Engineer & Administrative Officer, K.K.Nagar Division, Tamil Nadu Housing Board, Chennai, as a third respondent in this Writ Petition.

6. In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the impleaded respondent/third respondent to consider the petitioner's request on its own merits and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner, and any other interested persons within a

period of four (4) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
