These petition have been filed to set aside the abatement of above second appeal and bring on record the 10th petitioner/proposed 11th appellant as legal heir of the deceased C.T. Kamatchi in the place of the 3rd appellant in the above second appeal.

2.Despite name printed no one appeared on behalf of the second and third respondents. The learned counsel appearing on behalf of the respondents 4 to 14 (legal heirs of R1 and R4) there is no serious objection in allowing these petitions.

3.Hence, considering the submission made by the learned counsel for the appellant and having satisfied with the averments made in the affidavit, these petitions are allowed.
