O R D E R

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondent to pay 13 days Medical leave salary, difference in Gratuity by adding one year training period and surrendered 1/4

leave salary surrendered in August 2018, 2019, 2020, 2021 and 2022 with 10% interest to the petitioner.

3. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit that the petitioner has joined in the services of the Respondent-Transport Corporation as Helper Trainee on 19.08.1983 and after rendering nearly 39 years of continuous service and on attaining the age of superannuation, he retired from service on 31.03.2023. It is the further submission of the petitioner that after his retirement, the respondent has not settled the earned leave surrender, difference in gratuity and medical leave salary. It is the further submission of the petitioner that the training period of the petitioner was not taken into consideration for the purpose of calculating pension and gratuity. Claiming the above said benefits, he has sent a representation on 04.03.2025 to the respondent and such representation is pending with the respondent.

5. At this juncture, the learned Standing Counsel appearing for the 2/4

respondent would submit that the employee would become eligible for the gratuity and pension only from the date of regularisation. However, she would submit that the petitioner's representation would be considered, within a reasonable time.

In such view of the submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondent to consider the petitioner's representation dated 04.03.2025 and pass orders on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
