This petition has been filed to modify the condition imposed on the petitioner is directed to deposit a sum of Rs.1,50,000/- (Rupees one lakh fifty thousand only) as non-refundable deposit to the credit of Madras High Court Advocate Clerk Welfare Association, Chennai in the above Crl.O.P.No.17964 of 2024 dated 29.07.2024.

2. The learned counsel for the petitioner submitted that he is an agricultural coolie and he is college student, he has no means and he is not able to mobilise the amount to deposit to amount as directed by this court. Hence, the present petition has been filed to modify the condition.

3. The learned Government Advocate (Crl. side) appearing for respondent would submit that on search, petitioner along with other accuse was found in possession of 53 grams of Methamphetamine, however no recovery from him. Hence, he raised strong objections for modification of condition imposed by this court. 1/3

4. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit the sum of Rs.50,000/- (Rupees fifty thousand only) as non-refundable deposit to the credit of Madras High Court Advocate Clerks Welfare Association, Chennai, A/c No. 484077244, Bank : Indian Bank, Branch : High Court. IFSC Code : IDIB000M157 and on such deposit, the petitioner is ordered to be released on bail.

5. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 17964 of 2024 vide order dated 29.07.2024 shall remain unalterted.

6. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 08.08.2024 rpp 2/3
