These Criminal Original Petitions have been filed by the petitioners/A1 to A5, who were arrested and remanded to judicial custody on 30.06.2024, seeking bail in Crime No.297 of 2024 registered for the offence under Section 399 of IPC.

2. Learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners were no way connected with the alleged offence and they have been suffering incarceration from 30.06.2024. He also submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent raised objection stating that, when the respondent and his team were on their regular patrol duty, they found that the petitioners, who are respectively arrayed as A1 to A3, A5 & A4, were planning to commit dacoity in nearby places. He further submitted that the case is under investigation and further, one previous registered under Section 302 IPC is pending against each of the petitioner, therefore, if they are released on bail, there is every possibility of them absconding and not available for further investigation.

Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) and taking note of the fact that the investigation in this case is still pending and also considering the conduct of the petitioners, this Court is not inclined to grant bail to the petitioners.
