This Criminal Original Petition is filed to direct the 1st respondent to withdraw the investigation in Crime No.97 of 2024 and transfer the same from the 2nd respondent to some other agency. 2.

The allegations in the transfer application is that the two version of the accident not been properly reflected in the FIR and to safeguard the real culprits, FIR has been registered as if the brother of the complainant felt from his two wheeler on his own and sustained injury and taken to the hospital but the fact is brother of the petitioner was hit by an unregistered tractor. To safeguard the owner of the tractor, police has registered FIR with incorrect facts. 3.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the complaint was registered on the information given by the petitioner herein and for the sake of claiming insurance, now the second version been projected. The police has so far investigated 10 persons who were supposed to be present in the scene of occurrence and so far there is no evidence to show that the petitioner was 2/4

hit by an unregistered tractor.

The learned Government Advocate (Crl.Side) further submits that the investigation will be completed within 45 days and the based on the information collected during investigation, final report will be filed. The second version of the complainant will also taken into consideration while investigate the matter.

Recording the above said submission, this Criminal Original Petition for transfer is dismissed. The respondent police is directed to complete the investigation and file final report within a period of 45 days.
