Respondents Prayer:- This Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records of the 3rd Respondent in proceedings in Na.Ka.No.7808/A2/2007, dated 24.3.2008 and to quash the same, in so far as the Respondents 6 to 23 are concerned and to direct the Respondents to prepare the panel for promotion to the post of Head Master of Middle School for the year 2008 from among the eligible candidates who possess B.Ed/B.T. Degree qualification as per the Special Rules and give promotion to the Petitioner as Head Master of Middle School. For Petitioner :

ORDER

This Writ Petition is filed against the order dated 24.3.2008 of the 3rd Respondent and to direct the Respondents to prepare the panel for promotion to the post of Head Master of Middle School for the year 2008 from among the eligible candidates, who possess B.Ed/B.T. Degree qualification as per the Special Rules and give promotion to the Petitioner as Head Master of Middle School.

2. This court heard the learned counsel on either side and also perused the materials placed on record.

3. The learned counsel for the Petitioner would contend that the Petitioner had already made a representation dated 18.6.2008, which is not disposed of and that in view of the clarification made in the counter regarding the the earlier GOs and the Rules, it is suffice to direct the 1st Respondent to dispose of the representation of the Petitioner dated 18.6.2008, on merits and in accordance with law.

4. The learned Additional Government Pleader for the Respondents has submitted that as there was no records at that point of time, the representation of the Petitioner was not considered and the same would be considered and disposed of in accordance with the rules and regulations, within a time frame to be specified by this court.

5. Considering the submissions of the learned counsel on either side, the 1st Respondent is directed to dispose of the representation of the Petitioner dated 18.6.2008, on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition is disposed of No costs. Consequently, the connected MPs are closed.
