(Order of the Court was made by the Hon'ble Acting Chief Justice) This petition has been filed by the petitioners to condone the delay of 61days in filing the writ appeal.

2. The service report of the Registry records that the private notice taken on the sole respondent served on 23.09.2022. Proof of service has also been filed by the petitioners. Despite service, no one entered appearance on behalf of the respondent.

3. Learned State Government Pleader, appearing for the petitioners, submitted that the petitioners have obtained the certified copy of the impugned order on 23.5.2022 and on 15.6.2022, the same has been addressed to learned Special Government Pleader, Madras High Court for opinion for filing an appeal. He submits that learned Special Government Pleader has given his opinion on 21.7.2022 stating that this is a fit case for filing an appeal and in the

process of getting the certified copy of the impugned order and obtaining opinion, the delay of 61 days occurred. According to learned State Government Pleader, the delay is neither willful nor wanton. Thus, a prayer has been made to condone the delay of 61 days in filing the writ appeal.

4. Considering the submission made by learned State Government Pleader and having satisfied with the reason stated in the accompanying affidavit, the delay of 61 days in filing the writ appeal is condoned.

Accordingly, the petition is ordered.
