O R D E R

The petitioner, who was arrested and remanded to judicial custody on 16.05.2025 for the offences under Sections 296(b), 125, 311, 351(3) of BNS in Crime No.399 of 2025, on the file of the respondent Police, seeks bail. 1/4

2. The case of the prosecution is that the accused, by intimidating the de facto complainant at knife point, robbed a sum of Rs.550/- from him. Hence the case.

3. The contention of the learned counsel appearing for the petitioner is that the petitioner is innocent and has been falsely implicated in this case since he has several previous cases. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Criminal Side) reiterated the prosecution case and objected for granting bail to the petitioner stating that the petitioner is a habitual offender having 45 previous cases of similar nature. He further submitted that the investigation in this case has been completed and the charge sheet has also been filed. He further submitted that there are limited witnesses in this case and the respondent will be able to complete the trial at the earliest.

6. Considering the facts and circumstances of the case and the submissions made by the learned counsel appearing on either side, this Court finds that though the petitioner is aged about 29 years, he has 45 previous cases and further, the investigation in this case has been completed.

7. In view of the above, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. However, the learned trial Court is directed to complete the trial as expeditiously as possible.
