When the matter is taken up for hearing today, the learned Government Advocate (Criminal side) appearing for the respondent/Police submits that this is the case under the SC/ST Act and only appeal would be lie, in which, notice has to be issued to the de-facto complainant.

2. At this juncture, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to file an appeal under the provisions of SC/ST Act. To that effect, he has also made an endorsement in the Court bundle.

2. Recording the submission and the endorsement of the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn with liberty to file an appeal for the same cause of action raised in the present petition, and the Registry is directed to return the original documents to the petitioner.
