This Petition had been filed to condone the delay of 49 days in filing the Appeal in A.S.S.R.No.100387 of 2024.

2. Learned Counsel for the Respondent files counter denying the details stated in the Affidavit. Therefore vehemently objects.

Further he would submit that the Appellant/Petitioner was the Defendant before the trial Court and there also they delayed the proceedings wantonly.

3. Considering the right of litigation for filing Appeal, the petition to condone the delay of 49 days is condoned with imposing cost of Rs.2,000/- to be paid to the Tamil Nadu State legal Service Authority within a period of 10 days.

4. Registry is directed to number the Appeal, if it is otherwise in order and post the same for admission.

5. Accordingly, this C.M.P is allowed.
