M.E. Narayanaswamy Naicker v. V.Bhaherathi

C.M.P.No.19532 of 2023 in M.P.No.1 of 2008 in A.S.Sr.No.102098 of 2007 P.T.ASHA, J., This petition is filed to condone the delay of 1276 days in filing the above appeal.

2. Heard Mr.P.G.Santhosh Kumar, learned counsel for the petitioner/appellant and Mr.C.Selvakumar, learned Additional Government Pleader appearing for the respondent.

3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is allowed and the delay of 1276 days in filing A.S.Sr.No.102098 of 2007 is condoned.

4. The Registry is directed to number the appeal, if it is otherwise in order.

5. The learned Additional Government Pleader is directed to get the report from the Tahsildar with reference to the indigent circumstances of the petitioner.

6. The learned cousnel for the petitioner/appellant shall serve the copies of papers to the learned Additional Government Pleader. Post the matter on 24.04.2024.
