ORDER

The present writ petition is filed seeking for a mandamus to direct the 1st respondent herein to cancel the Patta Nos. 10687 and 10761, granted in favour of 6th respondent herein, as the same is contrary to Section 10 read with proviso to section 14 of the Tamil Nadu Patta Passbook Act and the Judgment of Honble Division Bench of Madras High Court in Vishwas Footwear Company ltd, vs The District collector and Ors. reported in 2011 (5) CTS 94 and consequently, direct the Respondents 1 and 2 to restore patta No. 3348 in respect of the property in S.No. 414/2-77 Cents at Kayarambedu Village, Chengalpattu Taluk and District to the name of Writ petitioners within a time stipulated by this Honble Court.

The learned Counsel for the petitioner would submit that the petitioner herein made a complaint before the respondents 1 and 2 to cancel the Patta Nos.10687 & 10761 and restore the Patta No.3348, which stands in their

names in respect of the subject property comprised in Survey No.414/2, measuring 77 Cents situated at Kayarambedu Village, Chengalpattu Taluk and District. In response to which, the District Revenue Officer forwarded the complaint to the 1st respondent vide letter dated 24.04.2024. However, the said complaint was kept pending by the 1st respondent. Aggrieved by the same, petitioners have come before this Court.

At the outset, it is submitted by the learned Additional Government Pleader appearing for respondents 1 and 2 that if petitioners submit a fresh representation for survey in respect of the subject property to 1st respondent, the same would be considered within a time frame that may be stipulated by this Court, which was agreed to by learned counsel for petitioners.

4. Taking into consideration the facts and circumstances of the case, the materials placed before this Court and the grievance expressed by the petitioners, there shall be a direction to petitioners to submit a fresh representation to 1st respondent along with necessary documents and on such request, the 1st respondent is directed to consider the representation submitted by the petitioners and pass appropriate orders on its own merits and in accordance with law, after issuing due notice to the petitioner as well as the private respondents and any other interested parties/rival claimants, if any within a period of twelve (12) weeks from the date of receipt of a copy of this

order. It is made clear that status quo granted by this Court vide interim order dated 02.08.2024, shall continue till the disposal of the representation by the 1st respondent.
