Crl.O.P.No.17831 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Balakrishnan, who was arrested and remanded to judicial custody on 25.05.2023 for the offences punishable under Sections 4(1)(A), 4(1)(a) of TNP Act in Crime No.309 of 2023 on the file of the respondent police, seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in this case. Petitioner is in Judicial Custody from 25.05.2023. Thus, he seeks bail to the petitioner.
3. The learned Additional Public Prosecutor submitted that, on 25.05.2023 at about 10.00.a.m., when the respondent police mounted surveillance near Pallapadi Village, they found the accused in a suspicious circumstances. On seeing the police, he tried to escape. Respondent Police apprehended him and found that, accused was in possession of 10 litres of illicit arrack and 8 numbers of brandy bottles each containing 180 ml. He further submitted that, apart from this case, there are 25 previous cases pending against the petitioner. 1/3
4. Considering the fact that, petitioner is a habitual offendor and there are 25 similar previous cases pending against the petitioner and also the fact that, investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original petition is dismissed. 07.08.2023 Sma 2/3
