ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 12.10.2021 for the alleged offences punishable under Section 174 (iii) of Cr.P.C and later it was altered into Section 306 of IPC in Crime No.283 of 2021, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the marriage was solemnized between the petitioner and defacto complainant's daughter Sowmiya/deceased on 26.11.2020. The petitioner demanded the amount of Rs.50,000/- and 1 sovereign jewels, which was given by the Government to the deceased under Marriage Assistance Scheme and the same was refused by the deceased. It is further alleged that there is a family dispute between the petitioner and his wife/deceased and due to mental stress,the deceased lady had poured Kerosene on her and set fire and died. Based on the complaint given by the defacto complainant/mother of the deceased, the case came to be registered. https://hcservices.ecourts.gov.in/hcservices/
3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.
4.The learned Government Advocate (Crl.Side) on instructions submits that the investigation is not yet completed. Hence, he vehemently opposed for grant of bail to the petitioner. 6.Considering the facts and circumstances of the case and also considering the submissions made by both counsel and also the fact that the grave nature of offence against the petitioner, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. -sd/- 10/11/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
